Terms of Service

By creating an account or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using our services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

Comsync provides an AI-powered conversational intelligence platform that includes:

• Pitch Pro: AI roleplay training using real customer conversations
• Insights: Analytics and performance tracking dashboards
• Recruit Pro: AI-powered candidate screening and evaluation
• Pitch Copilot: AI assistant for pitch preparation

We reserve the right to modify, suspend, or discontinue any part of our services at any time with reasonable notice.

To access our services, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security and confidentiality of your login credentials
• Promptly notify us of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

You agree to use our services only for lawful purposes. You shall not:

• Upload content that you do not have the right to use or share
• Upload recordings or data without proper consent from all parties involved
• Use the services to violate any applicable laws or regulations
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the integrity or performance of our services
• Reverse engineer, decompile, or disassemble any part of our platform
• Use automated systems to access our services without permission
• Resell or redistribute our services without authorization

You retain all rights to data and content you upload to our platform (“Customer Data”). By uploading Customer Data, you grant us a limited license to process, store, and use such data solely to provide our services to you.

You represent and warrant that:

• You have all necessary rights and consents to upload and process the Customer Data
• The Customer Data does not violate any third-party rights
• You have obtained appropriate consent from individuals whose data is included in recordings or transcripts
• Your use of our services complies with all applicable data protection laws

Our platform, including all software, designs, text, graphics, and other content (excluding Customer Data), is owned by Comsync and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

We may use aggregated, anonymized data derived from platform usage to improve our services. Such data will not identify you or any individual.

Subscription fees are billed according to the plan selected. Unless otherwise specified:

• Fees are due in advance and are non-refundable except as required by law
• Subscriptions automatically renew unless cancelled before the renewal date
• We may change pricing with 30 days' advance notice
• Late payments may result in service suspension

Both parties agree to maintain the confidentiality of proprietary information disclosed during the use of services. This includes Customer Data, business strategies, technical information, and other non-public information. Confidentiality obligations survive termination of these Terms.

We strive to provide reliable, high-quality services. However:

Our services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that our services will be uninterrupted, error-free, or completely secure. AI-generated outputs should be reviewed and validated before use in business decisions.

To the maximum extent permitted by law, Comsync shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising from your use of our services.

Our total cumulative liability shall not exceed the amounts paid by you to Comsync in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Comsync and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of our services, your Customer Data, or your violation of these Terms.

Either party may terminate this agreement:

• With 30 days' written notice for any reason
• Immediately upon material breach that remains uncured for 15 days after notice

Upon termination, your right to access the services ceases. We will retain your Customer Data for 90 days to allow for data export, after which it will be deleted unless a longer retention period is required by law.

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts in Bangalore, India. Before initiating legal proceedings, parties agree to attempt resolution through good-faith negotiation.

We may update these Terms from time to time. We will provide notice of material changes by posting the updated Terms on our website or notifying you via email. Continued use of our services after such changes constitutes acceptance of the revised Terms.

• Entire Agreement: These Terms constitute the entire agreement between you and Comsync regarding the services
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect
• Waiver: Failure to enforce any right does not constitute a waiver of that right
• Assignment: You may not assign these Terms without our written consent
